Is snus legal in the UK? The short answer

Tobacco snus is not legal to sell here and has not been for over thirty years. Tobacco-free nicotine pouches, which most British shoppers now mean when they say "snus", are legal to sell to adults aged 18 and over. The difference in law comes down to one thing: whether the product contains tobacco leaf.

That distinction matters more than the format. Both products are held under the upper lip and both deliver nicotine. Only one is caught by the UK's oral tobacco ban.

Why oral tobacco is banned

The Tobacco for Oral Use (Safety) Regulations 1992 prohibited the supply of oral tobacco in the UK from 1 January 1993, implementing a European directive. The ban has been carried forward ever since and now sits in regulation 17 of the Tobacco and Related Products Regulations 2016, in a single sentence.

That sentence reads: "No person may produce or supply tobacco for oral use." Sweden negotiated an exemption when it joined the European Union, which is why Swedish snus is still sold there and nowhere else in the bloc, and why British travellers encounter it abroad.

New snus offences in the Tobacco and Vapes Act 2026

The Act restates and extends the oral tobacco ban with three new criminal offences at sections 7 to 9. They sit in Part 1 of the Act, which under section 175(1) comes into force at the end of six months beginning with the day the Act was passed, making the commencement date 29 October 2026.

Section 8 carries a defence of having taken all reasonable steps to avoid committing the offence. On conviction on indictment, sections 8 and 9 carry up to two years' imprisonment, a fine, or both.

What changes for nicotine pouches on 29 October 2026

Nicotine pouches were not previously covered by tobacco or vaping legislation. The Act brings them in as "nicotine products" and applies the same age-of-sale framework that already covers vapes. Four changes matter most to anyone buying or selling pouches, and all take effect on the same date.

Section 15 is why free samples and promotional giveaways of nicotine pouches end on 29 October 2026. It applies to tobacco products, herbal smoking products, cigarette papers, vaping products and nicotine products alike.

Is it illegal to buy or possess snus in the UK?

The offences described above are aimed at production, sale and commercial supply. Regulation 17 prohibits producing or supplying oral tobacco, and section 9 of the 2026 Act covers possession with intent to supply in the course of business. Neither creates an offence of simple personal possession or use by an adult.

Advertising, sponsorship and what has not happened yet

The Act contains an advertising and sponsorship ban covering nicotine products, at Part 6. Unlike the Part 1 measures, it has no date written into the legislation. Section 176 provides that most of those provisions come into force on a day the Secretary of State appoints by regulations.

ASH reports that the ban is expected to come into force on 1 June 2027. Treat that as the intended date rather than a legal fact: until the commencement regulations are made, no date is fixed in law. Anyone quoting 1 June 2027 as settled is running ahead of the statute book.

Is there a legal limit on how strong a nicotine pouch can be?

No. Nicotine pouches have no statutory nicotine limit in the UK. E-liquids are capped at 20 mg/ml under the Tobacco and Related Products Regulations 2016, but pouches contain no tobacco leaf and have historically been regulated by default as general consumer products, outside that framework.

The voluntary BSI specification PAS 8877:2022, published on 28 February 2022, recommends a maximum of 20 mg of nicotine per pouch, a figure the Committee on Toxicity cited in 2023. GOV.UK's hand luggage guidance does not mention nicotine pouches or snus at all, so there is no published UK airport rule to point you at. Airlines set their own policies on carriage, and destination countries set their own rules on import and possession, which vary widely.
